The Federal Budget’s tax reforms are fundamentally changing the way discretionary trusts and capital gains are treated – including a proposed 30% minimum tax on discretionary trust income from 1 July 2028, and the replacement of the 50% CGT discount with cost-base indexation and a 30% minimum tax on real capital gains from 1 July 2027. Transitional arrangements, exemptions and restructuring relief only add to the complexity.
